However, when the owner passes away, that property can become a complex legal process if they don't understand how <strong>real estate inheritance works in Mexico.<\/strong>.<\/p>\n\n\n\n<p><strong>The transfer of real estate doesn't happen automatically.<\/strong> It doesn't matter if the heir has the keys or if there's a foreign will naming them as the owner: legally, the property enters into a probate process that must be handled in Mexico.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">How does real estate inheritance work in Mexico?<\/h2>\n\n\n\n<p>In Mexico, real estate is governed by the principle of territoriality: Mexican law applies, regardless of the owner's nationality.<\/p>\n\n\n\n<p>For an heir to legally dispose of the property, they must initiate <strong>probate proceedings<\/strong> before a Mexican notary or judge. The document must:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Be apostilled in the country of origin.<\/li>\n\n\n\n<li>Be translated by a certified translator in Mexico.<\/li>\n\n\n\n<li>Be validated by a Mexican judge.<\/li>\n<\/ol>\n\n\n\n<p>Therefore, real estate law specialists recommend executing a <strong>Mexican will<\/strong> exclusively for assets located in Mexico. This reduces time, costs, and the need for international travel.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Real Estate Inheritance Taxes in Mexico<\/h2>\n\n\n\n<p>Good news for foreigners and their families: Mexico does not have a federal inheritance tax (ISR) for children, parents, or spouses.<\/p>\n\n\n\n<p>However, associated costs must be considered:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ISAI (Property Acquisition Tax)<\/li>\n\n\n\n<li>Notary fees<\/li>\n\n\n\n<li>Public Registry registration fees<\/li>\n<\/ul>\n\n\n\n<p>On average, these expenses can represent between <strong>4% and 7% of the property's value.<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Estate Planning: The Real Key<\/h2>\n\n\n\n<p>Advance planning is essential to protecting your assets.
